By creating an account and using Memarti ("the Service"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Service. You must be at least 18 years of age to create an account. The Service is not intended for use directly by children.
Memarti is a platform for families to capture, organize, display, and preserve children's artwork and memories. The Service includes image capture, background removal, gallery management, family sharing, and related features.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date. You may not share your account with others or create accounts on behalf of third parties without authorization.
Memarti complies with the Children's Online Privacy Protection Act (COPPA). The Service is directed solely at adults (parents and guardians) and is not directed at children under the age of 13.
For users located in the European Economic Area (EEA) or United Kingdom, the Service complies with the General Data Protection Regulation (GDPR) and applicable national implementations.
You retain full ownership of all photos, artwork, and content you upload ("User Content"). By uploading content, you grant Memarti a limited, non-exclusive, royalty-free license to store, display, and process it solely to provide the Service to you. We do not share, sell, or use your content for any purpose beyond operating the Service. You may delete your content at any time from within the app or by deleting your account.
You agree not to upload content that is illegal, harmful, abusive, obscene, or violates any third-party rights (including intellectual property rights). You may not use the Service for any unlawful purpose, attempt to gain unauthorized access to any part of the platform, reverse-engineer the Service, or use automated tools to scrape or extract data.
Memarti offers paid subscription plans. By subscribing, you authorize recurring charges to your payment method at the applicable rate. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time from Account Settings. Refunds are handled on a case-by-case basis — contact us at asmith@edxpm.com within 7 days of a charge if you believe it was made in error. Payment processing is handled by Stripe and is subject to Stripe's terms of service.
We take your privacy and your children's privacy seriously. Your data is stored securely and is never sold to third parties. For full details on how we collect, use, protect, and retain your information — including your GDPR and COPPA rights — please review our Privacy Policy.
To the maximum extent permitted by applicable law, Memarti shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of content. Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.
You may delete your account at any time from Account Settings. We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice where warranted. Upon termination, your data will be deleted in accordance with our data retention policy (see Privacy Policy, Section 9). Any provisions of these Terms that by nature should survive termination will remain in effect.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation and are not liable for any loss of data or content. We recommend you maintain your own backups of important artwork and content.
These Terms shall be governed by and construed in accordance with applicable law. For users in the EEA, nothing in these Terms affects your rights as a consumer under mandatory provisions of EU law, including the right to bring disputes before the courts of your country of residence.
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notice before the changes take effect. Continued use of the Service after changes are posted constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you may cancel your account before the changes take effect.
